It is our absolute pleasure to be able to bring you the Lawikipedia Guide this year.

Firstly, we want to congratulate you on making it to UNSW Law and for all your achievements to date! You may have an idea of what law school is and it may even seem scary, especially as for some of you this might be your first year at university or at UNSW. In the first few weeks, you might find yourself a little lost or uncertain as you figure your way around.

To help you navigate this period of change, we are proud to present you with the Lawkipedia - a guide designed to give you some insight into what law school is like and what opportunities are on offer to enhance your time at university with the UNSW Law Society

ARRIVINGASAHIGH SCHOOLSTUDENT

The transition from high school to law school can be challenging as it involves a significant increase in the level of academic rigour and responsibility. Law school requires a great deal of reading, writing, and criticalthinking.Keepingupwithreadingsisdefinitelyachallenge!Itcan be a big adjustment, but I found that becoming involved with societies andgoingtoLawCampmadethetransitioneasierandmoreenjoyable!

Law school may seem daunting when you start, whether that’s not knowing others or the expectations of the degree. I reaped the greatest rewards by actively participating in events hosted by LawSoc and being involved. Whether that’s law camp (which I highly recommend), competitions, or other events, these are awesome opportunities to ease the nerves and meet people who will make the university experience an evenbetterone.Also,usethestudyskillsthatyoulearntinhighschoolto your advantage and see what works for you, do not be afraid to try differentthingsacademically!Takeeachweekordayasitcomesandtry tomakethemostoutoftheresourcesandpeopleavailablearoundyou.

ARRIVINGASA TRANSFERSTUDENT

As a law student who entered their degree via the IPT program, I initially suffered a huge case of imposter syndrome thinking that I was not as academicallydrivenorintelligentasmypeerswhoenteredthroughtheir ATAR alone. Being accustomed to independent online learning and prerecordedlecturesprovidedbyotherfacultiesduetothepandemic,Ihad lots of doubts about my ability to stay on track with the courses and remainontopofallmystudies.However,UNSWLawandJusticeprovides a great learning environment for all law students by building its foundation off in-person, interactive lectures; Where students are encouragedtoparticipateindiscussionsandaskquestions.Furthermore, by making it a requirement for all UNSW law students to study a double degree,IbelievethatthecohortswithinUNSWlawareabletoconsistently bring diverse and nuanced perspectives to seemingly fixed and traditional concepts. Along with the reasons discussed above, the LawPLUS mentoring program created by LawSoc made my first year in UNSW Law and Justice remarkable and my transition into my double degree seamless. I believe that the extra year at University should be regarded as an asset rather than something that a transfer student should be insecure about, the amount of university experience and soft academicskillsthatyouhaveaccruedwillgiveyouaheadstart.

“A new transition is always daunting for me, especially when there are additionalculturalbarrierswithoutfriendsandfamily.Theeasiestwayto break cultural barriers is to make some friends. It is difficult to make friendsinclassesbecauseweonlyseeeachotheronceortwiceaweek.I joinedafewclubsandactivitiesanditturnedouttobemybestdecision! Iwasabletohaveaclosegroupofpeoplewhohavethesameinterests asme.Forinstance,Ijoinedlawrevueasatechmember.Itwasaunique andmemorableexperienceandoneofmybestexperiencesinUNSW.We were in charge of drawing, building props and arranging how props are placed. The most satisfying moment is seeing how well the shows run andsingingtogetherafterashowpracticeends.”

To set yourself up for success, try and complete your readingsaweekaheadoftime,byusingthereadingguides uploadedtoMoodleduringOWeekoftheterm

Make annotations or summary notes as you do your readings to ensure that you are not simply passively reading the text. Summarise the content into your own wordsandlinkittotheoverarchingthemesofthecourse. Use the Pomodoro study method - 20 minutes study, 5 minutebreak.Itisscientificallyproventoboostproductivity, and maintain a balance without burning out - Perfect for longdaysofstudy

Understand AGLC 4th Edition referencing before you start yourassignment,asitcancauselotsofunnecessarystress close to deadlines. Reach out to your lecturer or a friend fromanolderyearforhelp

Using transparent sticky notes is the easiest way to annotate your law textbooks without diminishing their resalevalue,ordamagingthebookforfutureuse

The Law Society offers so many extra-curricular activities to take part in. Especially during your first year, where everyone is at the same beginner's level, having a go at everything is a great idea. Once you start hitting later years, you are not able to enter the beginner division and hence may have difficulty picking up the required skills. With the first-year workload,thereisnoreasonnottotryasmuchasyou can–youmightsurpriseyourself!

A piece of advice I wish I knew entering law school is that making friends during O-week and within my lecture classes is really important as it helps with easing into uni-life and comes with perks such as making study groups. Another bit of advice is never feel intimidated by others or the workload, University startsoffscarybutovertimeyou’llfindyourplacewith friendsandstudymethodsthatworkforyou!

To be intentional about the friendships you make! Your law school friends are going to be someofyourclosestpeersduringuni,asyou'll undoubtedly go through a lot with them. It's really important to establish genuine friendships with people you want to surround yourself with, rather than only focussing on making connections or social networking with thosethatcanbeofsomeadvantagetoyouor yourstudies.It'seasytogetcaughtupintrying to make connections that only benefit your career, but your university friends should be people who support you and vice versa This can make the stress of uni a lot easier when youhavegenuinefriendstoleanonandtrust! I would've signed up to LawPLUS before the program started! I finally did in Week 3 and wassogratefulthatIhadjoined!

Do not get discouraged by your marks in your firstyear.Lawschoolisdifferenttohighschool andittakesawhiletoadjust!Themarkyouget on your first assessment or exam does not defineyourfuturecareeroryourdegree.

ADVICEFORFIRSTYEARS

Navigating law school can be a daunting process. Something I wish I had known would be to ask for help whenneeded.UNSWoffersawiderangeofsupportforlaw students, evident through societies such as LawSoc, The Nucleusandmore!Ifyouneedanyadvice,don’thesitateto reachoutnomatterwhatitconcerns

Have an abundance mindset, and take every opportunity becausetheycanleadtosupergreatthings

HANDWRITE YOUR CLASS NOTES! I only started doing this in Term 3 of my first year, and I wish I had started sooner. I foundIabsorbedthelecturessomuchbetterwhenIhandwrote,becausenotonlydidIhavetimeJUSTforkeypoints, but I was able to draw diagrams, flowcharts etc, and structure my notes much more systematically, which is super important for subjects like torts and contracts. It’s also been proven across several studies within the last decadethathandwritingisgreatformemoryretention

I wish I had known the value of joining different skills competitions in my first year and how this would be valuable for growth and future opportunitiesinmylawdegree

Don’t compare yourself to others! Everyone is on their own timeline, and you will reach all your goalsinyourowntime.

Summarise your notes after every class (i.e., don’t wait until losing the plot the week before exams).

Use your lecturers/professors and do not be afraidtoaskforadditionalfeedbacksoyouknow whereyoucanimprove.

Onepieceofadviceistostayontopofdeadlines not only for required coursework and assessments but also administrative deadlines and dates for course enrolment and class selection. This alleviates the stresses associated withmissingoutonyourdesiredclasstimeslots and needing to be placed in a waitlist. The best waytomanagethisistocalendarinassessment and administrative dates as you receive them and set reminders for the week prior, the day prior,andthedayof Organisationalskillsarethe key to succeeding right off the bat at university andatlawschool.

Carefullyplanyourtrimesterbeforeitstartsas10weekscangobysuperfast. Takeasmanyin-personclassesaspossibletobuildconnectionswithstudents andallowuniversitytobecomeamoresocialexperience.

Work smart, not hard! You can have a work/study/life balance and do not have to dedicate all your time to law school and neglect making friends via joiningdifferentsocieties.

Enrolment can be stressful at the best of times but as a first year it can often be daunting and confusing. So here is a guide where we break it down for you and give you some tips and tricks for trying to make the experienceassmoothaspossible.

Enrollingiswhenyoupickthesubjectsyouwanttotakefortheyear-thiscanbe doneatthebeginningoftheyearbeforeunistarts.

MakesureyouenrolintoallofyourLawsubjectsatthebeginningoftheyear astheycanoftenbecomefull

Whenenrolling,youdon’tonlyhavetoselectyourclassesbutyouhavetotick the enrol box to fulfil your enrollment request. Once this is done your page shouldlooklikethis:

Registering is choosing the specific classes and the timetable you will have for eachterm

Make sure ahead of time you plan your timetable - cross angles is a great websitetouseforthis

ToknowwhichclassesyouneedtodogototheUNSWhandbookforyour specificdoubledegree.Therewillbesetoutarecommendedtimetablefor yourfirstyearandanoutlineoftheclassesyouneedtotake

Course progression plans are also a useful advice to have to guide your subjectselection

CourseEnrolment REGISTRATION

Ensure your details (home address, phone number, emergency contacts) are up to date a couple of days before registering for classes to save you from doingthisatthetimeofyourregistration

Lawclassesfillupquicklysomakesureyouareonthecourseenrolmentpage acoupleofminutespriortoyourclassesopeningthenexactlyatthetimeyour registrationopensrefreshthepage

Evenoneminutetooearlywillbeenoughtobaryoufromenrollinguntilyourelogin. Try to avoid this at all costs as it is highly likely that whilst you are reloggingin,yourfellowclassmatesarefillingupthespotsintheclassthatyou wanted.

As classes for law degrees fill up very quickly, pick these classes first and registerthembeforeyourclassesfromyourotherdegree.

Generally, enrolment spaces for other subjects are much less competitive, soprioritiselawsubjects

Other subjects are also likely to have students with a later appointment time/date than law students, so their availability is likely to be a lot larger thanyourrelatively‘small’lawclassesincomparison.

Remember to click “web delivery” classes before submitting your class registration request, otherwise it won’t go through and you will lose precious time

If you miss out on the spot you wanted and the class is full, register for the waiting list → It is likely that a spot will free up as it is not uncommon for studentstochangeclasses.

What is something you wish you knew in first year oratoptipyouwouldgivefirstyears?

When I came into UNSW, I had yet to learn about all the opportunities it had to offer - and it took me a long time to figure it out. My advice would be to keep an open mind and get involved as much as possible. Some of my closest friends came from getting involved in uni life, and I would encourage you all to throw yourself into every opportunity and to make the most of your time here at UNSW. Your youth is such an important time to discover yourself and who youare,soseekouteveryopportunitythatyoucan!

Ihighlyencourageyoutobeascuriousaspossibleandtoaskasmanyquestionsasyou can.Thisisthetimetomakemistakesandlearnfromthemsothatyoucangrowtobecome thebestversionofyourself.Ialsoencourageyoutoputyourselfoutthereinunfamiliar settingsandmeetasmanypeopleaspossible-theycouldbecomefriendsforlife

The Education Portfolio seeks to support the academic skills, professional development and wellbeing of students through a range of workshops, publications and initiatives Law schoolcanbeattimeschallenginganddifficult, with the Education Portfolio endeavouring to support students at all stages of their degree. Whether you are a first year navigating ILJ and learning about AGLC referencing for a first time, to a final year student on the cusp of graduating, the Education Portfolio will always be here to support you! Furthermore, the initiatives facilitated by the Education Portfolio complement the work of the Faculty to assist students in maximising their time at UNSW Law whilst equipping them with the skills needed to succeedbeyondlawschool.

As Vice-President (Education) for 2023, it is my vision for the Portfolio to reflect how there is no “one-size-fits-all” approach to law school and accordingly provide something for each and every student to benefit from. It is my aim to expand the portfolio to be more inclusive, providing a broad range of opportunities and resources to recognise the diverse nature of our law school community and the differing needs of students. I’m particularly excited to bring back the long-awaited return of the Electives Guide this year to assist later-year studentsnavigatetheirdegree.

It might sound cliche, but uni is truly what you make of it so do not be afraid to get involved! Coming into UNSW Law knowing literally nobody and not even being from Sydney, I can testify to the significant personal growth I have undergone from throwing myself into trying new things. However, on this note, it is important to remember to know your own limits and to try not to compare yourself to others - you might find that Mooting or Witness Examination is for you yet Negotiations is, and that is completely okay! Whatdoesyourportfoliodo(includeyourvision for2023)?

The Mooting Portfolio organises UNSW’s internal Mooting Competitions, provides mooting training materials, hosts training workshops and facilitates participation in a range of external mooting competitions where students are given the opportunity to moot against teams from otheruniversities.

Mooting is a simulated court proceeding where students prepare written submissions and deliver oral submissions in front of a panel of judges. It is an incredibly invaluable and rewarding co-curricular as it allows you to develop your skills as an advocate as well as your legal research and writing skills more broadly In doing so, mooting is an activity that also helps you improve inside the classroom - I definitely noticed an improvement in the way I approached law assignments and exams even after my first one or two moots. Most importantly though, mooting is a great way to meet new people across all cohorts. I have met some of my closest friends through mooting who have truly been the highlight of myuniversityexperience

My vision for 2023 is to make mooting as accessible and inclusive as possible! I want to achieve this particularly through providing even more training workshops and materials to make sure students are well supported as they navigate the differentinternalandexternalmootingcompetitions.

My top tip for first year students would be to get involved! Get involved in everything you have even the slightest interest in! UNSW is renowned for having a huge society culture (UNSW Law Society being the BEST one to join) so sign up to as many as you can. It is a very easy way to make new friends and feel comfortable at university during a huge transitionfromhighschool.

The Secretariat portfolio is responsible for providing governance, compliance and risk management services for the UNSW Law Society. We work closely with the Cabinet to ensure that we operate within the Constitution, Regulations and statutory requirements and ensure that Cabinet is running effectively. We also liaise with external stakeholders such as NSW Fair Trading, the Australian Charities and Non-for-profit Commission and Arc@UNSW on behalf of the Society.

The Treasury is responsible for managing all of Law Society's finances and ensuring that all portfolios have the necessary resources to run their events and initiatives as best they can! We work closely with the Presidents and the rest of Cabinet to develop regular budgets and draft expenditure-related policies. Throughout the year, we monitor each portfolio's spending such that they stay within the allocated budget and arepolicycompliant.

Additionally, as LawSoc is an ACNC registered charity and incorporated association, the Treasury is also responsible for producing financial reports and meeting our reporting obligations, which involves working closely with our auditorsandexternalgoverningbodies.

This was so far from the case - I learned that law students are the most adventurous and chaotic of them all. By the end of the third day of camp, people who were formerly strangers to me hadbecomemybestfriends-andtheyremainsotoday Campissucha brilliant way to create bonding - from raunchy team challenges, to wholesomemealtimeschats,tojungleparties,tostayingupallnightwith thepeopleinyourcabin…youhavenochoicebuttomakelifelongfriends who you will grow to love and be so grateful for. You also build amazing relationshipswithyourcampleaders.Icansayfirsthand,it’ssohelpfulto have friends in older years - not because they’re great people but becauseyoucan(andshould)stealtheirnotes Alljokesaside,myfriends and I at uni often reflect on camp and what it’s done for us. Law Camp is a great trip that takes place over a few days during the beginning of Trimester 1 every year. Put together by the Activities, Events and Socials Directors, this camp aims to take first-year undergraduate and JD students alike, out of Sydney, for an immersive and fun escape from the sometimes stressful start of your journey at UNSW Students are randomly assigned to groups of about ten, each with two older law students (camp leaders), with whom you’ll compete in a range of challenges, games and activities against other groups. There are prizes, laughs and law camp’s famous themed parties. The 3-day trip is designed to encourage first-year students to step out of their comfort zonesinasafeenvironment,whilstalsomakingheapsofnewfriends,that you will keep throughout the rest of your studies It also serves as a chance for younger students to get to know older law students, a great time for any questions about the university experience or a particular degree.Askanyseniorlawstudentabouttheirlawcampexperience–itis anopportunitynottobemissed!

LawBallisoneofthemosthighlyanticipatedeventsoftheyearwithinthe Law Society at UNSW. Anyone both within and outside of the Law Society can attend, making it an occasion not be missed! This event caters to around 600-800 people, all dressed to the nines for an unforgettable evening. It features live bands, a DJ, entertainment, food, drinks, photo booths,andlotsofdancing.

Law Ball is typically held at the end of the academic year and is a great opportunity to celebrate with friends, make memories, and meet new peoplefromvariousyearsanddegrees Iwouldhighlyrecommendgoing to Law Ball no matter what stage of your degree in, as it is arguably the biggestsocialeventoftheyear!

I thoroughly enjoyed getting dressed up with my friends and dancing all night,aswellasmeetingnewpeopleattheevent.It'sanincrediblenight toallcometogetherandmakememoriesthat'lllastalifetime.

SPORTWITH LAWSOC

Sports events with LawSoc are great ways to stay fit while making friends. In my opinion, there's no better way to bond with people than over some friendly competition while complaining that you ' re unfit! I’ve made some good friends playing on randomly selected teams,becauseeveryoneisthereingoodspirits,wantingtohavea goodtime Sporteventsatlawsocietytypicallyincludegaladays,a post-uni afternoon game followed by drinks or dinner, and involvementincharityrunsandcompetitions,suchasCity2Surf,and the Wings for Life run. There’s always a good variety of sports on offer too, including soccer, basketball, dodgeball, touch and oz-tag - to name a few. The sports games usually cater for both competitive and social levels, making it a perfect opportunity for everyone to get involved! LawSoc also offers events like ‘LawSoc goestoStateofOrigin’,orothersportingmatches-whichisgreatif youdon’tparticularlyloveplayingsports.SportseventswithLawSoc areespeciallyimportantconsideringthelevelsofstresswhichoften arise during term. UNSW Law comprises the Law School and a range of research, education and advocacy centres UNSW Law is governed by the Faculty Board which is composed of full-time academic staff, casual teaching staff as well as various nominees and student representatives. MOOTING

Mooting is a fun and rewarding extracurricular activity that challenges students to think creatively about legal issues. In moots, students pretend to be barristers in a simulated court proceeding. Competitors are given a fictional case and preparewrittensubmissionsbasedontheirownlegalresearch. Theythenpresenttheirargumentsinfrontofapanelofjudges. Participatinginmootingisagreatwayforstudentstoimprove theirlegalreasoning,researching,writingandoralpresentation skills. Students are given a unique opportunity to build on the knowledge and skills they develop in the classroom in a supportive environment. Mooting trains students to think like lawyers, understand the best ways to navigate legal rules and recognise the strengths and weaknesses in their own arguments. It is also social and a great way to meet people in your own cohort and other year groups. If I was asked to describe mooting in two words, I would say challenging and fun. So, what is mooting? And why is it challenging yet fun? Mooting is a ‘mock-trial’. It is where law students develop their legal, advocacy and research skills in a simulated court hearing.Studentscanapplythechallenginglawtheylearntoargue a fictitious legal dispute. However, mooting is not just about submissions. Mooting fosters an enjoyable and collaborative atmosphere for students to engage in a fun environment while simultaneously forming lasting friendships. My involvement in mootinghasunequivocallyallowedmetobuilduponmylegalskills while also giving back to the UNSW Law Society. Participating in competitions has inspired me to be courageous in seeking out opportunities for written and oral advocacy and thrive under the adversarial nature of mooting. NEGOTIATIONS

Negotiations stimulates the core aspects of real-world negotiation sessions between lawyers and clients. Teams of two, who represent opposing clients in a case, are briefed on the scenario and are required to discuss and present their interests and aims amidst often complex circumstances. Ultimately each team aims to reach a satisfactory and fair solution that meets the interests of both sides within 50 minutes.

Thenegotiationscompetitionshavebeenanimportantaspect ofmytimeatlawschoolsofar.Learninghowtonegotiatehas helped me in many ways, both in law school, work, and my personal life. Ultimately, the negotiations competitions teach you that the best way to get what you want, whether it be a client's interests in a professional setting, or your own interests in your personal life, is through compromise, communication, and mutual respect. In addition, Negotiations are a great way to meet new people in your cohort. Through negotiations and otherskillscompetitions,IwasabletomeetpeoplethatIwould probably not have met otherwise, enabling me to see a few morefriendlyandfamiliarfacesaroundcampus.

CLIENT INTERVIEWING

Client interviewing is a scenario-based competition where competitors aid a client in a legal matter as if they are in an initial consultation. This competition involves two partners assuming the role of solicitors, where they are given a one sentence “memo” 48 hours prior to the round. This often-ambiguousmemooutlinesthegeneralfeaturesoftheclient’slegal issues, which are then discussed in further detail with the client Client interviewingisafantasticopportunityforstudentsfromallstagesoftheir degree to develop key skills in communication, empathy and trust to nameafew.

Client Interviewing, a scenario-based competition, teaches the skills that are necessary for the communication between a lawyer and their client. Structured as a 30 minute interview, consisting of an introduction to the client, questioning the client, and posing possible solutions, the competitors,actingaslawyers,learnthatinformationgatheringisnotthe onlyimportantaspectofaclientinterview.Developingarelationshipand trust with your client is equally important and allows for longer term rapport This competition also explores issues surrounding the political and ethical realms, testing the competitors ability to respond to difficult, and often conflicting, situations If you are someone who is interested in developing these skills, applying their legal knowledge practically, and improving verbal communication and thinking on-the-spot, this is an opportunitythatyouwillnotregret!

Client interviewing is a competition that provides students with an invaluable opportunity to develop effective interviewing skills, such as communication, professionalism, teamwork and the ability to devise creative solutions on the spot. In a team of two lawyers, you are approached by a client with an issue. However, similar to reality, clients will not immediately tell you the full story, and can often be irrational, emotional and reluctant to provide information. Instead, you have the challenge of asking targeted questions to tease out relevant facts, in order to provide the client with appropriate advice to resolve any social, economic and/or legal issues. Client Interviewing is an ideal competition to participate in as a first year since it requires no prior legal experience and minimal preparation time. The competition is also a great way to form lasting connections while learning to communicate in an empatheticyetknowledgeablemanner. 79

MEDIATION

Mediation is a unique Skills Competitions offered by the UNSW Law Society which gives you the opportunity to showcase your negotiating skills and quick wit. In this competition, you and your partner take on the roles of lawyer and client. After receiving a fact scenario, you must develop a strategy and then participate in an 80-minute mediation. Unlike other competitions, an independent mediator aids all parties in exploring their interests and possible options. It is your job to further your client’s interests in the mediation. I participated in the Beginners Mediation competition in 2021 and it has challenged me and significantly improved my confidence, ability to think on my feet, and problem solve. Getting involved with skills comps (and particularly mediations) is one of the bestthingsyoucandoatlawschool.

WitnessExaminationisaskillscompetitionthatdrawsuponyourinnerAtticusFinch to use witness testimony to prove your case. In contrast to Mooting, Witness Examination relies less upon legislation and case law, and more upon the skill of questioningthewitnesses

Each team consists of two barristers and one witness (who does not have to be a law student) Junior Counsel for each the Appellant and Defendant delivers an OpeningStatementbeforetheAppellantdeliverstheiraffidavit,andissubsequently cross-examined by their opposition. The process then repeats for the Defendant, beforeSeniorCounselsdelivertheclosingstatements.

Feelfreetoamendyourownwitness’affidavit → UnlikeMockTrialinhighschool, it is not a requirement for witnesses to regurgitate their affidavit word-for-word As the barrister, you may edit the statement to draw attention away from facts that harm your case and towards those which give your witness credibility; as longasyoudonotaltermaterialfacts.

Examination-in-Chief should flow like a conversation → Although Examinationin-Chief is much shorter than Cross Examination, it is nevertheless an important display of skill. Show the judge that you are guiding the witness to explain their versionofeventsbyaskingsimpleandprecisequestions Ifthecommentsinthe affidavit no longer give a direct answer to the question you have asked, you should ask a new question This ensures that the witness statement appears accurateandauthentic

Prepare a clear line of questioning for Cross Examination → It is important to anticipate the answer to each question before you ask it. This is best achieved whenyourquestionsaresimpleandpromptayes/noresponse,withthehopeof backing the opposition’s witness ‘into a corner’ where their affidavit seems flawed. Ensure that you have mapped out different lines of questioning dependent on the witness’ potential answers, with planning helping you to think onyourfeetshouldyouneeditduringthetrial

Witness Examination is the prime opportunity in law school to put your Harvey Specter pants on and interrogate, cross examine, and crack a witness.

The competition usually revolves around a criminal trial – with two team members representing the prosecution and two the defence Each team is given the opportunity to prep their side’s witness for Examination in Chief,andtoCrossExaminetheotherside’switnessinacompetitionthat guaranteesanintenseandunparalleledexperienceinadvocacy.

Introducing Law and Justice is one of the first units you will complete in your law degree. It might come across as intimidating and overwhelming, but it prepares you for the units ahead. Introducing Law and Justice introduces you to the fundamentals to the Australian legal system and its development, as well as teaching you legal writing and researching skills. This unit contributed greatly to my research and writing skills, as it teaches case analysis, legal citation and essay writing. Being prepared before each lesson benefitted me substantially as it ensured that I was taking away a greater level of understanding of content following each seminar, especially given the complexities of legal writing and research. Learning about the historical aspects and influences to the Australian legal system is enjoyable and provides a foundation as to how the law operates. This unit teaches skills that are utilised throughout your entire law degree, so be sure to be prepared for eachseminarandworkonretainingtheresearchandwritingskillsyougain.

As your first case-heavy course, navigating Torts can initially feel really overwhelming I found that summarising cases in tables (using subheadings like‘facts’,‘issue’,‘held’,and‘relevance’)madeiteasierinexamstoidentifythe relevant case. Adding to this, specific situations (such as standard of care for children)onlyrequireonecaseauthority,sodon’toverwhelmyourselfbytrying to retain multiple cases that establish the same thing. It is worth familiarising yourself with the Civil Liabilities Act 2002 (NSW). While you are able to bring notesintotheexam,tomakethemostofyourtimeyoushouldtrytoremember the principles and only refer to your notes for ‘evidence’ (cases, quotes and legislation). The academic articles given can really shape your views on legal theory and you can gain so much from engaging with them thoughtfully. For exampurposes(youwillrefertoarticlesintheessay),takingnotesasyouread cansavealotoftimelaterbutit’simportanttorevisitthesenotesandrefresh your memory (and perhaps refine your interpretation) at the end of Week 10. For the finals, past papers are great and can be used to formulate ‘scaffolds’. Overall,Tortsisagreatopportunitytopractisewritingcriticallyofthelawandif youstayontopofthecontentandparticipateinclass,youwillbefine!

This course provides students with the fundamental elements of contractformationwhichactasakeyfoundationforfurtherexploringcontract lawlaterinyourdegree.Further,PrinciplesofPrivateLawdelvesintotheruleof privitywhichenablesstudentstounderstandtheapplicationofcontractlawto third parties. Later, this course transitions into property law including the classification of property and an individual’s rights in regards to property. In regards to property, Principles of Private Law introduces the concept of possession and ‘estoppel’, allowing students to understand the application of contract and property law My favourite part of this subject was the critical thinking it provoked in regards to what is considered property and further the topicalnatureofthecoursemadeiteasytoengagewiththecontentasmany of the cases and legislation had significant practical application to current events. The assessments in this course include a mid-term problem question and a final exam including a problem question and an essay question and of course,overallclassparticipationthroughouttheterm.Tomaximisesuccessin thissubject,stayuptodatewithyourreadingsandensureyouareconsistently summarising cases and legislation. Many of the key cases and legislation taught in this course have direct application to the elements of contract and propertylaw,allowingyoutoeasilyanswerproblemandessayquestions!Most importantly, do not be afraid to ask questions and do further reading on the elements of contract and property law A lot of this content is unfamiliar and mayappeardauntingbutoftenitjustrequiresabitofextratime!

PrinciplesofPublicLawisthelastsubjectyouwilldointhesecondyearofyour degree. You begin to explore the basic concepts of constitutional law, administrative law and statutory interpretation It lays the foundation for the federal constitutional law and administrative law units that you will complete later in your degree. I found it really enjoyable, as you get to explore the elements of Australian constitutionalism, and the issues within it. The most interesting parts of the course for me was working through statutory interpretation problems, and learning about the relationship between our First NationsPeopleandconstitutionalism(whichisveryrelevantleadinguptoour referendum) Also,youbuildmoreknowledgeontheseparationofpowersyou are introduced to in ILJ. This shows you the political elements of law, and introduces you to the powers of our government. Learning about politics and the law in this way made it really interesting to see and understand the roles that different aspects of society plays in the legal system. The statutory interpretation elements will be a fundamental skill that you will use in future subjects, and in your career as a lawyer. These problems were always very enjoyable as you start to understand why certain laws are enacted The best waytotacklethissubjectistotryandstayontopofthecontentthroughdoing yourreadingsandupdatingyournotes.Thiswasdefinitelyoneofmyfavourite subjectsIhavedonesofarinmydegree!

Crime&TheCriminalProcesshighlightstheLawandJusticefaculty’sfocuson thecriminaljusticesystem.Ifyoucomeacrossthiscourseinyoursecondyear, it’llbeanicechangeofpacefromtheverycivillawheavyfirstyear CCPoverall focusesonthenitty-grittyaspectsofthecriminaljusticesystem.Initially,you’ll learnabouttheoriesofcriminalisation,followedbytwoveryimportantareasof thecriminaljusticesystemtoday-policepowersandbail.You’llalsolearnhow to break down the elements of a criminal offence, as well as interpreting the criminal law statutes This class further covers public order offences and drug offences,givingyouatasteforwhat’stocomeinCriminalLaws.

I’d encourage you to ask a lot of questions in this course - many of the concepts can be rather abstract and certain legislation confusing to follow. Absolutely pay attention to the lecture slides that will easily outline for you the step-by-step processes in the examinable topics such as bail and police powers It is also vital that you are on top of your readings and notes, as the final exam covers a substantial amount of content. I also recommend doing practice statutory interpretation questions (you’ll hear a lot about ‘He Kaw Teh’).Keepanopenmindwhentakingthisclass-you’lldefinitelyfindmanyof your assumptions about the criminal justice system being challenged.
