Regarding this issue, LawNet would like to answer as follows:

1. Position and functions of Vietnam Government Portal

- Vietnam Government Portal is an electronic administrative information-integrating agency and a multimedia agency of the Government, which belongs to the Government Office and is directly managed by the Minister-Chairman of the Government Office (below referred to as the Minister-Chairman).

- Vietnam Government Portal has functions to organize, manage and publish official information of the Government and the Prime Minister; acts as the focal point in connecting the Government’s electronic administrative information network with Ministries, Ministerial-level agencies, Government- attached agencies, People’s Councils and People’s Committees of provinces and centrally run cities (below referred to as Ministries, sectors and localities), and relevant agencies and organizations; and integrates information on the Government’s online public services.

Vietnam Government Portal has international name in English: Vietnam Government Portal (abbreviated to as VGP)

- Vietnam Government Portal is an administrative organization, having the legal entity status, a seal with the national emblem and entitled to open an account at state treasury; its operating funds are assured by the state budget.

2. Tasks and powers of Vietnam Government Portal

Vietnam Government Portal shall assist the Minister-Chairman in performing the following specific tasks and powers:

- To assume the prime responsibility for, and coordinate with relevant units, agencies and organizations in, submitting to the Minister- Chairman for approval according to his/ her competence or to the Prime Minister for approval of strategies, important plans and projects, schemes of Vietnam Government Portal; to coordinate with relevant agencies and units in organizing the implementation after they are approved by competent authorities.

- To coordinate with relevant agencies and organizations in providing information for activities of the Government, the Prime Minister and the Government Office; to act as the focal point in organizing, managing and publishing official information of the Government, the Prime Minister and the Government Office on the Government’s electronic newspaper and the website of the Government Office.

- To coordinate professions and operations with Ministries, sectors, localities and relevant agencies and organizations in connecting and synchronizing the databases (not classified as state secrets), which are integrated in the Government Electronic Data Center; to standardize used software, exploit the national information resources;

To exploit, receive, integrate and fully and promptly update types of information (not classified as state secrets); to ensure compatibility and smoothness in the course of information sharing and exchange in conformity with the administrative reform program, meeting the requirements of the direction and administration of Government and the Prime Minister and the roadmap on formulating an e-government.

- To assume the prime responsibility for, and coordinate with Ministries, sectors, localities and relevant agencies and organizations in, integrating information on online public services of the Government.

- To coordinate with units of the Government Office in exploiting, receiving, processing and fully and promptly updating types of information (not classified as state secrets) for implementing the assigned functions, tasks and powers as prescribed by law.

- To assume the prime responsibility for, and coordinate with relevant units in, organizing press conferences, press receptions and press interviews of the Prime Minister, Deputy Prime Ministers and leaders of the Government Office; to perform the tasks of reviewing newspapers and summarizing press information;

To propose the Prime Minister and Deputy Prime Ministers to assign Ministries, sectors, localities and agencies to examine and report on issues given out by the press; to coordinate with relevant units in dealing with matters given out by the press as directed by the Prime Minister or Deputy Prime Ministers.

- To organize the management and operation of the Government’s electronic newspaper, website of the Government Office and other component websites as prescribed by law.

- To organize online exchanges, briefings and dialogues and other forms of interaction with the application of information and communication technology among the Government, the Prime Minister, Ministries, sectors, localities and agencies or organizations related to people.

- To receive reports and proposals sent by organizations and individuals via internet to the Government, the Prime Minister and state administrative agencies and send them to competent agencies or organizations, and request the settlement and replies thereof as prescribed by law.

- To design the technological, technical and artistic structure of Vietnam Government Portal and its information and data storage capacity; to diversify contents and forms of operation and multimedia applications, products and communication in order to raise the capacity of providing information on, disseminating the Party’s lines and policies and the State’s laws and socio-economic situation, the domestic and international news, effectively serving the direction and administration of Government and the Prime Minister.

- To assume the prime responsibility for, and coordinate with relevant agencies and organizations in managing, publishing and distributing printed and electronic Official Gazette of the Socialist Republic of Vietnam.

- To manage and operate the public-duty email system of the Government on the internet and the Government Electronic Data Center and technological infrastructure and special-use technical equipment.

- To manage and implement the assigned projects on investment and construction as prescribed by law; to give advice, design and appraise schemes, projects related to the professional areas of the system of websites/portals of Ministries, sectors, localities and relevant agencies and organizations as requested; to participate in the professional appraisal of other important projects assigned by the Minister-Chairman.

- To organize training and instruction on electronic administrative operations relating to the operation of Vietnam Government Portal as prescribed by law.

- To research and apply scientific and technical advances to raise the operational effectiveness of Vietnam Government Portal.

- To implement international cooperation in the fields of operation of Vietnam Government Portal as prescribed by law.

- To assume the prime responsibility for, and coordinate with units of the Government Office and relevant agencies in ensuring network confidentiality and safety as well as information security of Vietnam Government Portal.

- To implement activities of providing services and value increase as prescribed by law and guidance of the Ministry of Finance, ensuring to not affect the assigned political tasks.

- To manage the organizational apparatus and payroll; to implement the wage regime and preferential treatment, commendation and disciplinary regimes and policies to its civil servants, public employees, laborers and collaborators as prescribed by law.

20. To manage and use the assigned assets, allocated funds and other financial sources as prescribed by law.

21. To perform other tasks and powers as assigned by the Prime Minister or the Minister- Chairman.
