WARSAW, Ky. (WXIX) - A Gallatin County man, who was scheduled to appear in court this week on revenge porn charges, will also be charged with child porn.

Timothy Boles will appear in court for a pretrial conference on Friday. According to detectives with the Warsaw Police Department, Boles sent nude photos of a 17-year-old ex-girlfriend to people out of revenge.

A grand jury indicted Boles on 18 counts of charges related to distributing sexually explicit images without consent, distribution of matter portraying a sexual performance by a minor and harassment.

Nate Fuson, a former Warsaw police captain, said Boles had sent photos of the victim to her family members and friends.

“When she broke up with him, he sent out a number of explicit images and videos of her to get back at her for the breakup,” Fuson said. “At that point, she was embarrassed and really upset.”

Court documents say the victim was only 17 when Boles took the photos. This is why he’s now facing child pornography charges.

“The minute you distribute those images of a minor you have the crime of distribution of child pornography,” Fuson said.

Fuson said he wanted people to understand revenge porn has been illegal in Kentucky since 2018 after the legislature banned it.

“If you send out images of your former or current partner without their consent, that is a crime,” Fuson said.

As a warning, Fuson said people should be careful about disturbing photos of themselves if they’re sexual.

“Don’t send anything out,” Fuson said. “As soon as you send something out, you no longer have control of that image or that video. What happens to it is out of your hands and it’s out there forever.”

Court documents say Boles changed the victim’s SnapChat password so she couldn’t stop him from accessing some of the videos she had saved on the platform.
