It’s coming…. Open enrollment is right around the corner — and HR teams, and their insurance and broker partners, are bracing themselves. Months of preparation culminates in long days of benefit fairs, (fingers and toes crossed against) technology and shipping issues, and if your benefit plans have changed, anxious employees. It’s been awhile since I last sat behind a six-foot table with my brochures and tchotchkes, but I can say that those face-to-face conversations are what solidified a career-long dedication to them — the human beings of our health care system. The moms and dads and kids and young adults and older adults who just want to understand and to be confident they’ll be ok if they get sick or hurt. That’s it. At the end of the day, that’s what we all really care about. And it’s why I always recommend health care leaders spend a little time behind one of those six-foot tables and answer the questions of the people they serve. Here is a summary of the key points from 2023 Year-End Employee Benefits update from Quarles & Brady LLP. Pay attention to section: Complying with the Gag Clause Attestation Requirement by Year End. Summary: 📅 First annual Gag Clause Prohibition Compliance Attestation due by December 31, 2023 🚫 Plans must remove gag clauses from provider contracts that restrict transparency 📝 Plan sponsors must submit attestation online annually on CMS website. 🏥 Applies to most group health plans including self-funded, governmental, church plans. ⚖️ Plans that fail to comply may face civil penalties. 🔍 Sponsors should review contracts for gag clauses and amend if needed. 🤝 Service providers can attest on behalf of self-funded plans with agreement. ✍️ For new contracts, add language clearly defining gag clause expectations. 🗓 Prepare to complete attestation by December 31st deadline.
