Kohn Of the Post Dispatch Staff The Missouri Bar, which is opposed to letting graduates of the Laclede School of Law take the state bar examination, used an "irregular" procedure to send its views to the state Supreme Court, a lawyer says.

But the head of the bar replied that it used its ujual procedure, one that is satisfactory to the Supreme Court. Copies of the bar's recommendations were given directly to each of the seven Supreme Court judges last month rather than first being filed in the court clerk's office. As a result, attorneys for Laclede never Were told that the bar's report had been sent to the judges and were sent no copy of the report. "This is absolutely unbelievable, just incomprehensible," Samuel G. Ebling of St.

Louis, an attorney for Laclede, said Thursday when he was told that the bar's report had been given to members of the Supreme Court. Describing the bar's procedure as "irregular," Ebling added: "I've never seen anything like this in the more than 24 years that I've practiced law." But on Friday, John Fox Arnold of St. Louis, president of the bar group, described the bar's action as routine. He said Ebling had not been sent a copy as a result of "inadvertance" but that a ropy had been mailed to him Friday. "The bar traditionally has delivered reports to the members of the Supreme Court individually and to the office of the clerk of the court," Arnold said.

"That practice was followed in this instance. In addition, it is our understanding that no docket number was assigned to this matter." But Ebling noted that the Supreme Court had assigned a case number to the matter. Classes at Laclede meet in the evening on the Fontbonne College campus in Clayton. Laclede has 28 students and 19 faculty members; it is unaccredited. All students at Laclede hold full-time jobs.

Prospective lawyers in Missouri, as in most other states, must pass an exam before they can be licensed to practice law. Laclede has filed a petition asking the Supreme Court to allow its graduates to take the exam. Officials in the clerk's office at the Supreme Court said the docket sheets for Laclede's petition for accreditation in effect, the official record of all papers filed in the case fail to indicate that the bar filed a report for the court's cdhsideration. Chief Justice Albert L. Rendlin did not return telephone calls Thursday and Friday on the matter.

Ebling says he expects to ask the Supreme Court for permission to file a response to the bar group's report after he receives it. One of the state courts' Rules of Civil Procedure law permits papers to be filed directly with a judge, but the rule requires also that the judge send any papers "forthwith" to the office of the clerk. The rule requiring notice to all parties or their attorneys states: "Every pleading, subsequent to the original petition shall be served on each of the parties affected thereby." Laclede is seeking an exemption from a state Supreme Court rule that permits only graduates of schools approved by the American Bar Association to take the bar examination. Laclede lacks its own building and multimillion-dollar library. It is not seeking ABA accreditation.

The school's supporters include some well-known judges and lawyers ia the St. Louis area. They argue that its graduates are highly motivated and would be well-trained and competent lawyers. But the bar contends that letting graduates of Laclede take the exam would lead to problems with out-of-state "law-diploma mills" and that the existing standards are necessary to ensure that only qualified lawyers are licensed to practice in Missouri. Carroll, who spent 25 years as a priest in St. Louis, his native city, before becoming bishop of Wichita, died Saturday of cancer in a hospital in Wichita. He was 88. Bishop Carroll, who retired from his post in Wichita in 1963, was often considered ahead of his time during his 40-year career. He was an early advocate of using English in liturgical celebrations and, in the 1930s, began a campaign against religious bigotry.

In 1951, he became the first Catholic honored with a citation from the National Conference of Christians and Jews. He often traveled for the conference as a speaker on ecumenism. He was ordained a priest in 1922 by Cardinal John Glennon and was consecrated a bishop in 1947 by Archbishop Joseph Ritter. In St. Louis, Bishop Carroll was vice chancellor of the archdiocese.

He also served here as pastor at five churches, including St. Margaret of Scotland and the Old Cathedral. He was founder of the Old Cathedral's museum and, in 1931, the Cathedral Latin School, a high school for students preparing for the priesthood. In Wichita, he was responsible for carving the Diocese of Dodge City out of the Wichita diocese; he petitioned the pope to split up what Bishop Carroll thought was too large of an area for one bishop to administer. In the territory that remained in the Wichita diocese, Bishop Carroll saw during his tenure the building of 205 churches, schools and hospitals.

Under his leadership, Kansas became the first state to send lay members to Catholic missions in Latin America. The current bishop of Wichita, the Most Rev. Eugene J. Gerber, said, "Bishop Carroll was fully a man, fully a priest, fully a bishop. We in the Diocese of Wichita shall long reap the harvest of the seeds sown by his love of truth, love of God and love of life." A funeral Mass for Bishop Carroll will be celebrated Wednesday at noon at St.

Mary's Cathedral in Wichita. Burial will be in Wichita. He is survived by two sisters, Catherine Schiller and Marie Altekruse, both of St. Louis. ANDERSON, JAMES CARL, Jan.
